Cyberspace sovereignty means that a state has the power to carry out activities and deal with affairs in the cyberspace independently, the equal right of enjoyment of the cyberspace resources and participation in international governance of the cyberspace activities and the power of taking self-defense against cyberspace attacks. Cyberspace sovereignty is a manifestation of national sovereignty in the cyberspace, is the development of national sovereignty in the Internet age, and in essence, cyberspace sovereignty is a part of the national sovereignty. Cyberspace sovereignty has the characteristics such as more prominent relativity, determining jurisdiction with difficulty, being affected by technical factors. Currently, the opinions on the cyberspace sovereignty of the international community are not completely consistent, and cyberspace sovereign faces some difficulties.Cyberspace security mainly refers to the security and stability of the cyberspace, the cyberspace conducive to the development of the country as a whole, and there is no threat from network activity against the national security. The reasons lies in the cyberspace security issues are contention on cyberspace interests, openness and anonymity network design, abusing advantages of cyberspace technology and a lack of cyberspace security of rules. Cyberspace security is facing some threats, such as more and more serious cyber monitoring, intensified cyber arms and so on. From the perspective of international law, cyber security issues can’t be effectively addressed because that, firstly there isn’t a broad consensus on the theory of cyberspace sovereignty, secondly the international cooperation situation on cyberspace security has not yet formed, thirdly the international law system on cyberspace security hasn’t been built.Cyberspace sovereignty and cyberspace security are closely linked and go together. On the one hand, the cyberspace sovereignty is the basis of cyberspace security. From the domestic point of view, the cyberspace sovereignty is the theoretical basis of laws on cyberspace, and the theoretical basis of the national jurisdiction cybercrime. From the international perspective, the cyberspace sovereignty is a fundamental principle of international norms on cyberspace security, the basis of international cooperation on cyberspace security, the basis of the supervision on cyberspace of intergovernmental international organization, the basis of a sovereign state to protect its own interests in cyberspace, and the theoretical basis of a country to exercise the power of taking self-defense. On the other hand, cyberspace security is a guarantee to cyberspace sovereignty. Firstly, cyberspace security is an important component of national security. Secondly, cyberspace security is also a premise for the maintenance of cyberspace sovereignty, i.e. cyberspace security is a realistic basis for the effective exercise of cyberspace sovereignty, cyberspace security is a premise to consolidate the status of cyberspace sovereignty in international law, and the cyberspace security threats also affect the cyberspace sovereignty.In order to effectively safeguard the cyberspace sovereignty and cyberspace security, on the basis of clarifying the relationship between the cyberspace sovereignty and cyberspace security, our cyber security strategy should be developed as soon as possible, and the cyber security legislation should be improved, the widespread international recognition of cyberspace sovereignty should be promoted continue, the principle of cyberspace sovereignty should be adhered as the basic principle to solve cyberspace security problems, and the role of intergovernmental international organizations should be given full play.
