China and South Korea began to established diplomatic relations in1992,between the two countries in political and economic exchanges and cooperation in the field of the increasingly close.Especially after the Olympic Games in Seoul, South Kore,South Korea’s rapid economic development,cause a lot of demand for labor.According to the survey,South Korea’s population aging speed has been ranked the world’s first name,conservative estimate to2018South Korea aging rate more than15%,South Korea’s domestic labor cost increase greatly.To the cost is relatively low in China, the corresponding requirements and less chance of the surplus labor of migrant workers to go to Korea.China foreign economic cooperation mainly includes three most project contracting, labor cooperation and design consultation, economic cooperation with the south Korean business in China, the proportion of labor service cooperation is approximately96%.China to South Korea domestic labor export not only transfer the part of the surplus labor force, make part of the labor force increases the income, but also increase the foreign exchange to the nation, to a certain extent promoted the development of domestic economy.But to the rights and interests of most people in South Korea in the workers can’t get a good security, has become the outstanding social problems for many years.How to protect the legitimate rights and interests of transnational labor export staff has become an important hot topic in the field of human rights theories at home and abroad.This article through to the Chinese Korean labor export in the actual investigation of the rights and interests, more in-depth analysis in Han Zhongguo workers rights and interests of the cause of the damage, and based on the international human rights conventions, from reality to better protect the legitimate rights and interests of Chinese Korean labor export in useful countermeasures are put forward..This paper mainly includes the following five parts:The first chapter, introduction.Mainly from the three aspects discussed the significance of this study, one is conducive to the long-term development of china-rok relations between the two countries, the second is conducive to the sustainable development of labor service export market in our country, three is to safeguard the legitimate rights and interests of workers in Korea.At the same time analyzed the research status at home and abroad, and points out the innovations and shortcomings of this article.The second chapter, the development of China on the south Korean labor export and the main way.Mainly expounds the development course of China on the south Korean labor export including the historical background of political and economic exchanges between the two countries, and analyzes the Chinese can become South Korea the main causes of labor importer, and the development of China on the south Korean labor export has been divided into three stages according to the time period.For south Korean labor export in China at the same time introduces the main way is divided into two ways, the governmental and non-governmental official way including academic system of industry, employment permit system and access to the employment system, folk way including study abroad, visiting relatives, etc.The third chapter, China’s labor export rights conditions in Korea.Mainly through interviews with some of the workers in Korea real life situation to reflect the status of their rights and interests, and then analyses the condition of labor service personnel’s right to exist in Korea, security rights, social rights and the right to development conditions.The fourth chapter, the analysis of the causes of workers rights and interests is damaged in Korea.One is the south Korean policy on Chinese Korean compatriot instability;Second, Korean society of China to Korea’s labor will not be enough recognition;Tlree is to maintain to the lack of labor rights and interests of relevant laws and regulations;Four is informal intermediary organizations to fraud to workers;Five is to workers in the domestic left-behind children lack of love.The fifth chapter, strengthen labor export staff rights and interests protection countermeasures in Korea.
