The Legal Regulation Of Our Occupational-Disease-Prevention

In China, with the rapid development of our social economy, as well advanced modern industry, the harm of occupational disease is more and more serious. In order to improve our current occupational disease’s legal regulations, through four parts’ introduction I will try to analyze these problems from daily law-enforcement; hope can bring some help to all.The first part is the basic knowledge introduction to occupational disease; the second part is introduce and analyze the defects during the prevention activity of occupational disease, list6problems:the relief ways to diagnosis objection、unfair on sharing the legal responsibility、short of assistance and compensation policy、the detailed responsibility of union organization、how to connect between occupational disease policy and the industrial injury insurance system、control system; In the third part, I recommend and compare the different occupational disease’s legal regulations from the American legal countries and the Civil Law countries, summarize their experience and effect to China; the last part, I think how to improve occupational disease’s legal regulations. From the legislation side, we can try to perfect it through setup advanced legislative thinking、 improve the double assistance policy、add ways to diagnosis objection、make an occupational disease’s diagnosis application right、and the labor worker has the right to know etc.; From the law enforcement side,watch out for the status of occupational disease、enforce prevention concept、insist on strictly management to employers etc.Through above introduction, I hope it can help and improve our occupational disease’s prevention work, protect labor workers’health right, finally we can come true the harmonious society.
