From The Perspective Of Institutional Ethics During The Civil Enforcement Of Transformation

In recent years, our society is in a critical period of transition, when there are profound changes in the economic system; great changes in the social structure; reasonable adjustments in interest structure and deeply changes in concept and idea. At the same time, opportunities and contradictions mutually intertwined, which makes the various types of cases rapidly increase, and make the court accept the more and more civil cases. This fact reflects that people want to protect themselves with the law and the rule of law, which is providing a good opportunity for our government being ruled by low. However, there are problems in the civil enforcement, which hinder the development of China’s rule of law. This situation has been concerned by many sectors of society, as a result, there are many academic researches in civil enforcement over a decade, but the difficulty in " civil enforcement " has not been solved now. From a practical perspective, the law as an expression of national force, rigid enough but not so flexible to solve all the problems, which is not suitable to the current environment. Good social management should have the characteristics of the times, should pay attention to the demands from all sides, should be a way to ease the pent-up emotion. As an institutional ethics research paper on all aspects, it examines the civil cases, which will measure the implementation with a just, fair and open view, in the hope of provide new ideas to ease the implementation difficulty. Overall, this paper is divided into five parts:The first part mainly talks about the difficulty in civil enforcement and explains the research significance of the issue;The second part mainly talks about the current domestic researches of the difficulty in civil implementation;The third part is included with a detailed discussion of the enforcement, a lists of difficulties in civil enforcement and a definition of the object of enforcement which is meant to find the focus of this paper;The fourth part is a deeply analysis on the difficulty in civil enforcement form the perspective of the Institutional Ethics.The fifth part provides specific operation methods on Institutional Ethics to solve the problems in the civil enforcement.
