Research On Juvenile Gang Crimes

In recent years, the Juvenile gang crime problem has attracted widespread attention inthe whole society, investigates its reason, mainly in the following two points. First, the specialsubject of crime.The young as a reserve force of the country’s sustainable development,represents the future of the country and the hope of the nation, the juvenile healthy growthaffects the whole social nerve.Secondly, a special form of crime. Compared with the singlejuvenile crime, gang crime ability, high success rate of crime, which is harmful to the societymore. Research on juvenile gang crimes, it has the high theory value and practical value.Therefore, the author through the collection of relevant data, using the value analysis method,empirical analysis method and normative analysis method, try the characteristics, theformation and the prevention of juvenile gangs, systematic and clear their views. This paper isdivided into three part, the introduction on the structure, the text and the the conclusion,totaling40733words. The introduction part briefly discusses the research background,significance and purpose, the definition of related concepts involved in article, and a simpledescription of area of Chongqing city as the study sample.The text mainly includes the following three aspects.First, introduce the general situation of the A court juvenile gang crimes from January of2011to june of2013. Through analysis, the conclusion are follows.(1) The number of A courtcases showed rising trend.(2) The subject of crime of no more than a fixed occupation,cultural degree is low, and the first offence. Therefore, we should pay equal attention to theireducation and punishment, to help them rebuild and return to society.(3) Their crime focus onthe types of property crime and violent crime, crime motive is simple, and has a certaindegree of randomness and blindness.(4) Criminal gangs based small and medium, thestructure of the organization is loose, but on the whole tends to close. This is not be ignored. Second, with the above empirical analysis and based on the criminal origin theory, fromtwo aspects of the possibility and reality reasons of juvenile gang crimes. In probability level,juvenile and become a potential criminal attracted by the instinct need not satisfy and gang. Inthe practical level, due to the excitation of external factors, the potential crime become areality, the juvenile gangs formed. Specifically, these external factors include four aspects,namely the right situation of crime, victim issues, social system is not perfect and the legalsystem is not reasonable.Third, based on the above analysis, puts forward the prevention of juvenile gangsmeasures. We should improve the macroeconomic environment, appropriate to meet the needsof juvenile and provide support to children and their families. Then, we have to improveschool management, improve the quality of teachers and regulate unhealthy culture,construction of civilized community. Then pay attention to situation crime prevention andvictim prevention, the emphasis is on prevention of theft and robbery. The last is theprevention of juvenile gang crime. We must take the lenient criminal policy as the principle,while retaining the application space of severe criminal policy, and suggests that the juvenilejustice law independent.
