A Study On The Legal System Of The Clean Energy Fund In China

The clean energy fund of china plays an important role in the exploitation, utility,promotion and development of the clean energy. The lack of relevant legislation andinadequate laws and regulations of the clean energy fund leads to the difficulty in operatingthe fund. In order to shed light on the inadequacies of the legal system of China’s CleanEnergy Fund, and to make recommendations for the development of it, this thesis will analyzeclean energy fund’s problems reflected in its development under the circumstances of civilcharity, government regulation and market dominance.Firstly, this paper clarifies the concept of clean energy fund after probing into themeaning of clean energy and the fund. Then it introduces the main forms of clean energyfunds according to the different sources of funds, and at the same time, it also reveals thenature and the function of the fund. Secondly, after sorting out the laws and regulations whichcould be applied to clean energy fund, the paper analyzes four issues of the fund, includingthe single source of funds, the lack of supervision, the opaque use and the asymmetricinformation disclosure. Finally, on the basis of the experience of clean energy funddevelopment in the US, the paper makes four recommendations for the improvement of lawsand regulations of clean energy fund, including broadening the sources of funds,strengthening governance structure of the fund, regulating the use of funds as well asimproving the Information disclosure of the fund.
