| As an important part of NGO and one of the three market economic parts parallel withgovernment and enterprises, Associations plays an irreplaceable role of great importance. Itserves as the bridge between enterprises and government, industry and market; it is theorganizer, coordinator and supervisor of industry self-management; it is an indispensable partand important social push that helps to perfect marketing system, to standardize market orderand to facilitate economic and social development. However, since China is still in the stageof social changes, associations haven’t developed long enough, related legal regulations andpolicies are not ready, and the self-organization and management program are notstandardized, especially because of the bad organization of association credibility constructionsupervising and self-disciplinary mechanism, some associations are driven by interest andignore their social responsibility, so they have a very low credibility, which brings down thesocial image and public credibility of associations and influences the normal development andeffect of associations. Therefore, how to improve the credibility of associations has become atheoretical issue of great importance and emergency.By theoretical and case analysis of credibility deficiency of associations in China, thispaper points out internal and external causes of credibility deficiency, based on whichmeasures of legal governance within and outside of associations are suggested to improveassociation credibility. In addition to the introduction and conclusion, this paper is composedof five chapters.The first chapter synthesizes international notions of association and based on thepractical situation in China brings up the concept of association in China and analyses thenature of associations. Meanwhile, the concept of credibility is introduced-in contrast withcredibility in other disciplines, the connotation of credibility is clearly explained andphenomena of association credibility discrepancy are concluded. In order to solve the problemof credibility discrepancy, association credibility construction is very meaningful andimportant. To this point, this paper proposes to strengthen credibility construction by legalgovernance and verifies its validity from the point view of jurisprudence.The second chapter analyses the external environment of association credibility discrepancy. The unavoidable disadvantage of market economy and challenges encounteredafter entering the market both influence association credibility. Moreover, the closerelationship between association and government also influences association credibility. Forexample, some associations in China are too much administration-related, which is veryharmful to association credibility construction. Furthermore, rule by law in China is notperfect with many loopholes, so the lack of legal assurance also affected credibilityconstruction of associations.The third chapter analyses the internal cause of association credibility discrepancy inChina. First of all, the objective and motivation of association organizer have a directinfluence on association credibility construction. Secondly, lack of standardization ofoperating system restricts association credibility construction. Last but not least, since lack ofability, some associations have difficulty making profit which also constrains its credibilityconstruction.The fourth chapter suggests that external legal governance should be strengthened inorder to solve the problem of association credibility discrepancy. This includes the perfectionof relative legal regulation to clarify the independence of association by law and make relativelegal mechanism of credibility construction in law.The fifth chapter emphases that while improving external governance against associationcredibility discrepancy, internal self-governance mechanism should also be paid attention to.This includes that association regulation construction should be strengthened and internalrules shall be completed and a credibility risk prevention mechanism for association should beconsidered. |
