Online shopping has changed the traditional shopping patterns,It brings greatconvenience to consumers. Only need to click the mouse or the keyboard, people canstay at home to get what they want. Express service will also get benefits, it hasdeveloped rapidly in recent years in the domestic. With the rapid development of theexpress service, dispute comes out one after the other. The high rate of complaints,the weak foundation, the shortage of facilities, law and regulations are not perfect arethe main reasons. In recent years,China has revised "postal law","Service of expressof national standard","express market management measures" also have been issuedto constraint express enterprise’s inappropriate behavior.But There are still someproblems need to explore,although It can solve the contradiction between theconsumers and the express delivery enterprises.In order to solve dispute betweenconsumers and express enterprises,An authoritative guidance and constraint systemsmust be bulit, and the rights and interests of consumers can be effectively protectedfrom that.This article divides into four chapters:Chapter one is about the reason and significance for the damage of consumersduring express service, Including the external and internal factors and somecontroversial problems.Chapter two is about the basic issues in the express service contract. The mainlycontradiction of the express service’s dispute reflected in express service contract.These chapter also include the relationship between express enterprise,sender andrecipient.Chapter three is about the legal problems of the express service liability for tort.Express Service damages involves not only the responsibility of breach of contractalso involves the tort liability. Chapter four is about the protection for consumers. The consumers’rights couldbe protected from market access, normative express service contract and theconsumer rights protection mode.
