| The Criminal Law Amendment Eighth has added the crime of dangerous driving，whichis set in one of one hundred thirty-three Penal. Since the Amendment Eighth was carried outon May1,2011, all parts of our country climax to combat the crime of dangerous drivingbehavior. So the phenomenon of drunk driving has been effectively curbed in a short time,and the concept that drunk driving is a crime spread rapidly in the social public. Therefore,drunk driving into the penalty initially achieved the desired effect of social governance. So far,law enforcement of the drunk driving crime behavior has been more than two years time, anddangerous driving also shows some regular features in the judicial application, at the sametime some specific issues for dangerous driving need to be deliberated.As the judicial Application of dangerous driving in Chongqing Zxian from2011to2013to the survey sample, this paper presents and analyzes the applicable status, characteristicsand underlying causes for dangerous driving offenses in the past two years in Zxian, also itsummarizes and analyses the problems of dangerous driving offenses in the judicialapplication in past two years.On this basis, the paper proposes some ideas and suggestions toperfect the penalties applicable of dangerous driving from the perspective of the legislativeand judicial driving offenses.This paper is divided into five parts:The first part is the application of dangerous driving offenses. By analyzing andarranging the dates for the main features and results of dangerous driving in Zxian, the papersummarizes the basic characteristics of the penal appliance to judicial practice for thedangerous driving in Zxian.The second part analyses causes for the application of dangerous driving offenses. Thepart summarizes the reasons of the basic situation and characteristics which has presented bythe dangerous driving crime in Zxian.The third part is the problem in the application of dangerous driving offenses. Throughexploring nature of the phenomenon, the paper summarizes the defects and hazards ofdangerous driving in Zxian even in all our country from the point to the surface.The forth part analysis causes of application of dangerous driving. This section analyzesthe reasons for the problem of dangerous driving in practices deeply.The fifth part makes some suggestions for the application of dangerous driving.The paper puts forward some ideas and suggestions for the penal appliance of dangerous drivingin the terms of improving the legislation and refining the law enforcement. |
