Research On The Application Of Law To The Crime Of Drunk Dangerous Driving

In recent years,the number of motor vehicles in China has continued to increase.The management of the behavior of motor vehicles and drivers has become an important problem to be solved urgently in the society.Among them,the drunken driving behavior influence is extremely bad,constitutes a serious violation of the safety and the life of others.In this regard,China began to implement the Criminal Law Amendment Eight from May 1,2011."Drunk driving into punishment" is formally written into the law of our country,which to a great extent curbed the occurrence of drunken driving.However,an increase in a new crime needs to be tested by time and practice,and in the meantime,there will be a variety of problems.At present,in the judicial application of "drunk driving into punishment",there are still no small disputes in all walks of life.In this regard,to strengthen the analysis and discussion of "drunk driving into punishment",to solve the problem of "drunk driving into the sentence" is very critical.The intoxicated driving into the criminal law is the transformation of the criminal law concept from the "result offense" to the "behavioral offender",which reminds the perpetrator of the dangerous anticipation time,which is beneficial to the function of the criminal law.Drunk driving is a irrational performance,although most people are rational,there are still a few people who lack "self-discipline" and think that even drunk driving will not be a problem.The rule of "drunk driving into prison" has played a deterrent effect.It should be said that drunken driving into criminal law is in line with the demands of public safety travel.On the basis of previous related research,this paper focuses on the study of the legal application of drunk driving,with a view to providing more clear advice and reference for the legal regulation of this act.
