Food safe or not is directly related to the realization of the human life safety and health. Throughout the world, accidents frequently appear in the field of food safety.Therefore, establish Food Safety Rights and protect it as a basic human rights is of great urgency.The change of environment, frequent food safety problems, the development of food and biotechnology technology are three big backgrounds of the appearance of Food safety rights. Environmental pollutionthrough the pollution to the environment of agricultural production which directly lead to food safety issues. Those frequent global food safety problems, such as "Mad cow disease" event, "Sanlu milk " incident, having become common social problems around the world. Food and biotechnology developments brought an great convenience to people,at the same time also brought new challenges to the protection of food safety. The three backgrounds led to the emergence and development of food safety authority.In the process of development of Food Safety Rights, its content and nature also gradually began to be clear. The essential nature of food safety in human life has produced particularity nature of Food Safety Rights in the human rights protection system, therefore,the rights to food safety is not only the basic human rights in the sense of international human rights law, but also shall be the legal rights safeguard by international law. Food Safety Rights has clear content: Safe food rights, Food security information rights, the rights of food to choose, and the rights of relief for security. Safe food rights is the premise of guarantee for Food Safety Rights. The rights to food safety, including food safety, a number of available and sustainable ways to get food. Food security information rights and food to choose is the core of the Food Safety Rights. Relief security rights have provided support for food safety. Since where there have rights, there will be reliefs, the four rights of food safety authority linked together, make up the rights to food safety guarantee system.Food Safety Rights is a need of international recognition of basic human rights.As the world’s largest international organization, The United Nations should play its proper role. First of all, the UN should set up specialized agencies which is responsible for dealing the problem of Food Safety Rights. The challenge of food safety bring to the international community is huge, only rely on a country is not a efficient way, adding specialized agencies and food safety expert group in the UN are the most effectiveapproach. Second, adding food safety in international human rights treaties. The modern international human rights treaties simple regulate on food safety will not be able to meet the need of practice in the international food safety legislation. Again, the UN human rights council should also be urging sovereign states to speed up the food safety legislation.The UN human rights council should be formed with further review system of Food safety right on the basis of system, each sovereign state should also form independent reporting system, to protect food safety effectively and systematic.
