Study On Legal Issues Of The Moon Development Commercialization

With the development of the world space and aeronautics industry and increasing ability of the space activities, the moon means to human is happens thorough change. Now human have the advanced space technology and constantly updated of the space equipment, along with strengthening of international cooperation and exchanges and the trend of commercial space activities is quickening, the moon is not any more a unreachable dream, a real moment of develop moon and the other space resources is not a far stretch.But the realistic develop activities has not started, one of the important reason is the international community has not set up a new set of legal regime which is whole and constraining force for moon development and the legal problems of develop moon resources is not reach an agreement. The international treaty about the moon exploration and development, except for minimum rules in Treaty on Principles Governing the Activities of States in the Exploration and Use of Outer Space, Including the Moon and Other Celestial Bodies, and only thirteen countries ratify Agreement Governing the Activities of States on the Moon and Other Celestial Bodies, the moon exploration is not the other legal basis. With the second moon boom began in the end of 20 centuries, every country in addition pursuit of scientific interests, the commercial interests has also become hot, e. g. Russia and America has launched a manned aircraft for commercial purposes, even on the front page of lunar embassy event, so factual proof, human is not stick to the moon scientific exploration, the commercial development of the moon to obtain commercial interests is the goal of the future. Thus, it means:there is no clear legal provisions that the right and obligations of human development main body for moon; how to define the moon development commercial; hot words moon’s traveler; there is no specified rules about how to develop the moon resources; the moon development activities have not effective guidelines and rules;A series of the legal problems about the development and commercialization of the moon:first, how to define the development of the moon and commercialization types and tendency; second, analyzed the exist international treaties about the development of the moon, the result is minimum operability but have an important significant; third, analyzed the Russia and America faultless domestic air and space law but nothing rules about development the moon; fourth, analyzed the development commercialization of the moon faced some problems: how to define the space traveler, environment pollution; fifth, reference the exsit model of the international maritime bureau, the model of development at the South Pole and the model of the moon co., LTD; sixth, analyzed the legislative status of China, suggested perfect the China’s space legislation.Although the thesis talk about the legal problems of the moon development commercialization, the tendency of many country develop and use of space resources, and China does not like the other countries legislate the domestic space law, China whether join the new area, how to develop, use of space resources, faced of a series of problems such as being able to response to outer space interference and destruction, both follow with advancement of the Chang’ er project to solution. This is also the law students and the scholars of law research for fighting.
