The Legal Status Of The Urban Itinerant Traders

Whether in China or the other countries in the world,urban itinerant traders more or less infesting the city has become a phenomenon for common people.They may be convenient to people’s lives,or blocking traffic.All of that disturb the normal order of society.In view of this problem,prohibiting their business activities may not be a wise solution.In China, there are contradictions or even bloodshed between urban itinerant traders and urban management can be often the hit the newspapers.The deep reason lies in the incorrectness of identification of juridical status for urban for urban itinerant trades.They do not have legal status in our country,which fundamentally deny the legitimacy of their business activities.But the survival right should be the basic rights of every citizen.Prohibiting the business activity of urban-itinerant trader would hinder their full enjoyment of their survival right.Therefore,the exploration of legal properties of itinerant traders.analysis of its legal existence path has become an important work.the legal person should have the sensitivity to face the social reality.This paper is divided into four parts based on the analysis of urban itinerant traders.Firstly,this paper explians the connotation,definition and composition of urban itinerant traders,to konw the reason of selection of mobile business.Secondly,this paper analyzes the main character of urban itinerant traders and then analyze their status in current legal system form three aspects of civil law,commerical law and administration law comprehensivly.Third parts focus on the mode analysis of urban itinerant traders in other countries governance,combined with the actual situation of our country,in order to put forward what our country can learn from.The finally part puts our country business main body cognizance standard as the breakthrough point,and the adoption of the cognizance standard of our country,in order to put forward the identified standard proposed urban itinerant traders as a class of business feasibility of the main program.Learning from the successful experience abroad and some cities in urban governance itinerant traders,I think the existence of city itinerant traders is reasonable.Therefore,analysis of their main character,and incorporation into our present legal system for regulation has very important theoretical and practical significance.
