The Problems Of Grass-roots Legal Aid And Its Solutions In Our Country

Implementation of grassroots legal aid, like the touch of the sun in the winter, for the poor and vulnerable groups of society spraying a piece of warm sun, let them stand equal before the law. Unfortunately due to legal aid in our country relatively late start, the system was also not perfect, especially in recent years, grassroots legal aid work faced some problems to be solved, the rights of social poor and vulnerable groups did not get effective guarantee, seriously impacting on social stability and building a harmonious society. Therefore, it was of important practical significance to further improve the relevant provisions of grassroots legal aid and enhance the level of work to meet the social demand of legal aid, for guaranteeing rights of the poor and vulnerable groups, safeguarding judicial justice, building a harmonious society and achieving the constitutional principle of "equality before the law".This paper is divided into three parts:The first part is the summary of grassroots legal aid. It not only elaborated the concept of the legal aid and its historical development in Western countries, but also focused on a brief historical process of proposing, establishing and improving the legal aid in our country. At the same time, combining with the concept of the legal aid and legal aid practice all over the country, it defined grassroots legal aid in our country.The second part is the section of the status quo analysis. It mainly analyzed the characteristics and problems of grassroots legal aid in our country combining the legal aid work status of Jiyang County. Through analyzing, the characteristics of grassroots legal aid mainly manifested the diversity of aid workers, state responsibility of aid funds, the unity of aid work, extensive of aid object and range, the free aid service and the richness aid form,etc. While the problems embodied five aspects that the legal aid institutions lack of personnel attraction, huge gap between supply and demand for legal aid, unbalanced growth of various types of aid cases, legal aid funding unsustainable and supervision and management of the case becomes a mere formality.The third part is the section of improving solutions. On the basis of the analysis of the current situation and problems, this part explored effective path to improve grassroots legal aid from four aspects that legislativing specially to promote legal aid, unifying management agencies form, establishing grassroots legal aid office of lawyers and improving the mechanism to ensure funding to explore effective ways of improving grassroots legal aid.
