| The right to education is not only important human rights recognized and guaranteed by international convention, but also statutory rights stipulated by many national constitutions and law. Respect, protect and fulfill the right to education is not only the domestic law obligations in accordance with national constitution, but also a necessary requirement for countries assuming their obligations under international law and fulfill the commitment of the international conventions.The development of human rights is a process of continuous progress, after World War II, many countries together made a series of protection of human rights of international documents, the right to education as human rights a has also been a lot of general or regional human rights treaties recognized, especially the provisions of Article 13 of the "International Covenant on Economic, Social and Cultural Rights", is currently in the world on the right to education provisions of the most comprehensive international convention on human rights.For a long time, education is a prerequisite for social development which have great significance on personal growth and social progress. Because education can improve people’s living conditions and social class, education fairness can provide a breakthrough social differences as individuals, to a certain extent laid the foundation of social justice, therefore, it is necessary to analyze the education rights from the perspective of education fairness.This text includes four chapters. Chapter 1 "overview of the right to education in international human rights law", it mainly studies the related concepts of the right to education and the social significance of the education right from the perspective of educational fairness.The second chapter "the provisions and analysis of the right to education in international human rights law",This chapter studies the universal treaties and the provisions of the regional treaties, such as Europe, Africa and Latin America, on the right to education.The third chapter “some developed countries about the right to receive education and promote education fairness of system designâ€, this chapter describes the right to receive education in the practice of the United States, Japan, Britain and other developed countries and promote the effective system of education fairness.Fourth chapter "in international human rights law and the right to receive education in Chinese practice research", into the 21 st century, the issue of human rights in our country by focus attention, China also joined relevant international human rights treaties and fulfill the treaty obligations to protect the citizens right to education is inviolable efforts and made certain achievements. But there are still unfair phenomenon in the protection of citizens’ right to receive education in educational practice, the reason education unfair phenomena can be from three aspects of economic development, the traditional concept and the allocation of resources analysis, how to solve the unfairness of exist in practice. It deserves to continue thinking and exploration how to solve the problems of contemporary Chinese educational fairness in practice. This paper includes three aspects: First, establish fairness in education concept, second, improve the policy guidance, third, strengthen the legal protection.In the conclusion part, the thesis make a summary, then once again stressed the importance of human rights to receive education, finally prospects the future development of the cause of human rights of our country and in the world human rights development in China should bear the responsibility. |
