Research On Legal Protection Of Cultural Rights Of New Generation Of Migrant Workers

With the new generation of migrant workers is becoming an important group of urban society, the infringement situation of cultural rights issue has become a focal point the state and social concerns. It was mentioned in the proposal, the state should focus on the protection and maintenance of cultural rights of the new generation of migrant workers, Improve the monotonous situation of cultural life, improve their cultural literacy. As an important group of workers, cultural literacy of the new generation of migrant is closely related to the overall quality of China’s laborers,working to improve the quality of their culture conducive to the stability and development of society. As a group of urban social life,their cultural life is an important part of urban life, enriching the cultural life of the new generation of migrant workers is the requirements of implementing the constitutional concept of respecting and safeguarding human rights. To solve the issues of the new generation of migrant workers’ s damaged cultural rights, the central and local governments on the one hand improve the cultural legal system, on the other hand implement the equalization of public cultural services strategy, reduce even cancel the barriers to entry cultural sites, eliminate the possible restrictions of generation of migrant workers may face when they entry into public culture sites. Government invests funds for the cultural construction of the new generation of migrant workers, organizing various cultural activities to enrich the cultural life of the new generation of migrant workers and help them integrate into the city. However, the current poor situation of cultural life of the generation of migrant workers does not fundamentally reverse.Discrimination against migrant workers in cultural sites still exists.Because of lax supervision, vulgar culture products is flooding in the region they gather, which explains the legal protection of cultural right of the generation of migrant workers need to strengthen.This paper consists of three parts: the first part, define the scope of the new generation of migrant workers, analyze the basic situation, then analysis the concept, content and nature of cultural rights of the new generation of migrant workers,and then describes the theoretical basis for legal protection of cultural rights of new generation of migrant workers. The second part,describe the current status on legal protection of cultural rights of new generation of migrant workers from both the legislative and executive firstly, and then analyzes there are problems on the legal protection system. analyze the causes why there are problems on the legal protection system at last. The third part, make a few suggestions on the refining and improving the legal protection of cultural rights of new generation of migrant workers from the legislative, executive and judicial aspects.
