The Criminal Law Amendment (Ⅷ) since May 1,2011 formally promulgated and implemented, because of its previous criminal law is a revision to its strongest, most widely, both in the field of theoretical research or in the judicial practice are far-reaching and lasting effect, subject to wide attention from all sectors of society. The main content is to some penalty has been adjusted, the two is to further strengthen the protection of criminal law on the people’s livelihood, aggravated crime to some serious violations of people’s life security punishment, the prison penalty execution to mainly to bring long-term effect of organ. The Criminal Law Amendment (Ⅷ) the promulgation and implementation of hand it perfects our penalty structure, is conducive to further punishment and prevention of crime, maintain social stability and harmony; and on the other hand, because it does not fully take into account the current situation of China’s current penalty execution work, and when the former "give way" the education transformation method against, too much heavier prison penalty execution organs such as the burden to the society, buried under a new hidden trouble. This paper on The Criminal Law Amendment (Ⅷ) discusses the influence which produces to the execution of penalty implementation work, and puts forward some relevant suggestions by combining with the practice, in order to attract attention to the work of the prison, to contribute to our country penal execution work progress and development. Although with the deepening overall reform deepening, the national criminal justice system in continuous complete, but the penalty system, especially the penalty execution of prison work to really meet the rule of law and social requirements, embody the fairness and justice of the society, still has a long way to go.
