Intellectual Property Protection And Data Usage License In Scientific Data Sharing

With the development of "big data era", scientific data have penetrated into many aspects of scientific activities. Nowadays, the scientific data sharing become very important and urgent in many research fields. Scientific data, as the representation of scientific researches and verification, which can help researchers use the existing scientific dates for improving the scientific explorations and innovations, and also promoting the sustainable development of the science. However, there are many challenges in sharing scientific data. The most prominent problems are the protection of intellectual property rights and data licensing issues in scientific data sharing. If lack of an effective data licensing framework, the data would be abused by others. But excessive focus on the data protection, will limit the use of scientific data by researchers. To solve the contradiction between the protection and sharing of the data, we must complete the data license and build scientific data model to protect intellectual property rights. However, the protection of intellectual property rights can maximum the interests of data producers, and to drive the scientific data sharing in achieving a high development. Therefore, exploring efficient alternatives to past data protection has attracted considerable attention in the future and still remains a major challenge. At the early stage of our country to promote the practice of the scientific data sharing, because of less attention on the protection of intellectual property rights, so the interests of the data producer cannot be protected, and actually block the development of the scientific data sharing.In this paper, we conduct two aspects of intellectual property protection and data license, several intellectual properties and data licensing were introduced include the concepts and connotations. The importance of intellectual property protection and data license for scientific data sharing is explained in the aspects of its characteristic, function and concrete application. From the perspective of scientific data center, in order to resolve the contradiction between protection of intellectual property rights and scientific data sharing, we prompt a data management method to strengthen the data sharing. From the perspective of promoting data sharing, we conduct to establish a set of suitable data licensing for scientific data sharing, for realizing the protection the rights and obligations of data producers who sharing the data to science research, as well as the data protection of intellectual property rights, to promote the formation of the scientific data sharing environment, and realize the leapfrog and sustainable development of data sharing in China.Based on the present development situation of Environmental and Ecological Science Data Center of Western China, the existing problem of protection of intellectual property rights and scientific data sharing, and relevant scientific data protection problems are analyzed. In order to further highlight the importance of intellectual property protection in the current scientific data sharing. The data licensing which established in this study were applied to the practice of the scientific data sharing. And the data licensing prototype framework was also designed for the data center.
