Study On The Mechanism Of Making Verdict Public

Verdict is the carrier of court judgment, record of trial process and declaration of law. To make public of verdict is the proper meaning of Judicial Transparency which is the necessary condition to prevent the judicial corruption, maintain the judicial justice and guarantee the legitimate rights and interests of citizens. Also, it is the effective way to improve citizen’s legal quality and promote judicial unification. Although we have put forward the idea of the openness of verdict in China, we have no advanced substantially. In recent years, the judicial reform is getting much deeper,and the publicity of verdict has got due attention. Meanwhile, the mature of Internet technology provides great power to promote the openness of verdict in China. Although the verdict disclosure system has developed rapidly in China, there are still some problems in the connection of relevant system, construction of platform and open procedure and approval.Although the verdict public rules in our country has improved a lot, we still have much things to do in coordinate the law system, and infrastructure construction. This thesis starting from the connotation and function of the openness of verdict, this thesis analyzes the necessity of establishing the verdict disclosure system in China and examines the history of the verdict disclosure system in China. Moreover, through the methods of literature review, comparative analysis and data statistics, it concludes the legislation and practice of the current verdict disclosure system in China and analyzes the defects and deficiencies of the verdict disclosure system in China in legal basis, platform construction, and authority supervision and information protection. Lastly, combining with the actual situation, it puts forward the corresponding suggestions of perfecting the verdict disclosure system in China in improving legislative level, optimizing platform technology, expanding the range of openness and guaranteeing right relief.
