With the process of promoting the rule of law and the development of the nationalpolitics and economy, the function of regulating social relations and resolving conflicts isgrowing more important. People’s juridical needs and the expectation of justice isincreasing day by day, and the overall consciousness of the social supervision is graduallyunprecedented. However, in the cases, the contradiction between judicial verdict andpublic opinion is escalating. Specifically, the public tend to concern about the facts ofcases, caring little about the legal issues of the cases. They often put their focus on socialinjustice, official corruption, moral and ethical issues and so on. Once the publicopinion outbreaks, it will take much pressure to the administration of justice. So how todeal with the relationship has become a primary problem in the process of rule of law inChina. Western system has become more consummate, our current freedom of the pressand independence of the judiciary also needs improving. In this background, it isunpractical if we copy the Western measures blindly. So we should take our country’snational conditions into account to solve our problems. I hope my advice can be favorablefor the judicial practice in this article.This article is divided into four parts, except for the introduction and epilogue.The first part is an overview of the basic theory between public opinion and judicialverdict, including public opinion’s connotation, its characteristics and its affections onjudicial verdict.The second part sets forth the historical development of the relationship betweenpublic opinion and judicial verdict, including the historical development of ancient Chinaand the historical development of contemporary China, and the experience of the westerncountries.The third part elaborates the main contradictions and conflicts between public opinionand judicial verdict, including manifestations of the conflicts and the causes of the conflicts.Based on the analysis of the conflicts of them, author will put forward some advice.In the fourth part, the author offers some suggestions to balance and coordinate theconflicts between public opinion and judicial verdict, referencing to the experience of thewestern countries. I hope this article’s discusses can be conductive to the maintenance ofhuman rights and the course of justice.
