Study On Administrative Regulations Of The Internet Finance

Internet finance is a kind of newly-developing financial form that is based on Internet payment, cloud computing, social networking, search engines and other Internet tools, which provides service such as financing, payment and information brokers. Internet finance has appeared along with the development of science and technology, and constantly changes in the meanwhile, which makes economy prosperous and people’s life convenient. In 2014 the government works report indicates: "We need to deepen the reform of financial system, promote the healthy development of the Internet financial and perfect financial supervision coordination mechanism." Which shows that the development of the Internet finance has caused the attention of the government? Since the current Internet finance has many hidden troubles, and its legal status is not clear, and it is outside the financial supervision system, if the supervision is inadequate, it will bring large challenges for the financial system safety as well as social stability. Therefore, it is urgent to strengthen Internet financial regulation, and the surpervipn should focus on the law regulation. For conducting administrative legal regulation about the Internet finance, there are many problems which need be solved urgently such as perfecting the corresponding administrative law regulation system, making clear that who is eligible to take part in the Internet financial activities(that is access condition), and what can do, what cannot do, as well as making clear that various kinds of Internet financial activities should be regulated by which departments at the same time. In this paper, it can be concluded that conducting administrative regulation is rational and necessary by analyzing the characteristics of the Internet finance. Finally, it puts forward reasonable suggestions which are based on the analysis and definition of administrative law regulations legal principles, introduction of present situation and the insufficiency as well as extraterritorial experience to perfect Chinese Internet financial administrative law regulations.
