According to the recent investigation of CNNIC 2010, in the year 2009, in China, the trading volume of shopping has arrived 250 milliards, which makes twice as much as the last year.A data showed that in 2009, people who use the internet to shopping has reached 108 millions, which has increased 45.9% annually. This practice of shopping on internet continues to go up to 28.1% until now. As long as the popularization of the idea of shopping online, it goes to be the habitude of netizen life. Since the mode of internet trading has its own strength like high efficiency, low cost and a series of others to which the traditional mode of trading cannot compare, it is expanding gradually its market influence; in this new situation, the consumers raise more rigorous requirements concerning the security, the brand, and the service of internet shopping.Nevertheless, along with the rapid development of internet trading and some relative services, many problems and headaches that cannot be resolved have exposed step by step.Therefore, to establish a special administrative regulation and the structure of such rules, have a very important and realistic significance in the resolution of those problems, in order to ensure the security of internet trading, to hold a normal exchange orders and to gear up and guide the continuous development of internet economy. Face to the intervention of the administrative powers in the internet trading market, quite a good deal of personnel of research raise doubt, because they think that the internet is only a virtual space which doesn't exist in the real life, hence, the intervention of administrative powers hasn't the legitimacy. This thesis aims to defend the legitimacy of the intervention through the method of demonstration. And to reflect a series of social problems as a result of the absence of administrative regulations in the present internet trading and other some service actions in China, through an analysis of the actual situation and cases study. Then to compare the laws and administrative rules in China and oversea, to research the institution structure by means of finding out the theoretical sources in two dimensions as laws and economics and laws and sociology. At the end, in accordance with the present situation of Chinese internet trading and in concerning the traditional system of market executive rules, to make an explanation on the main questions which need to be tackled immediately: market admittance, tax collection and management, product responsibility, domination's conflicts, and to make remarks upon the system of administrative regulations in the internet exchange market from the two sides of vertical and horizontal. |
