The Research On Government Information Disclosure Upon Application System Execution

Along with the arrival of information era and emerging participatorydemocracy, a world and globalization trend is publically found ingovernment information. Especially, the Government InformationDisclosure upon Application System, which is promoted by constantmotive power of citizen practice, is not only the effective way to promotethe sufficient application and optimal allocation of governmentinformation resources, but also necessary element to promote the politicaldemocracy participated in and developed by citizens. On May1,2008,the Regulation of Government Information Disclosure of People’sRepublic of China symbolized the beginning of Chinese informationlegislation. However, the release of the Regulations does not mean thecompletion of government information disclosure system. It can be foundin the case study and analysis that the government information disclosureupon application system encounters various legal problems in practices.Many barrier elements influence the implementation of modernlegislation process, which is mainly reflected in legal barriers, process barriers, and various realistic difficulties in reply affirmation of thegovernment information disclosure upon application. Problems includedivergence of system and incomplete monitoring system.Based on the research object of Huangpu District in Shanghai,through the description on implementation situation of governmentinformation disclosure upon application system in Huangpu District, thedifficulties in government information disclosure upon application arediscussed by relevant data statistics and case analysis. Meanwhile,suggestions and countermeasures are proposed to improve governmentinformation disclosure upon application system. For above problems, it issuggested that through the construction, improvement, completion, andoptimization of government information disclosure upon applicationsystem, a guarantee shall be provided to express the real effect ofgovernment information disclosure upon application system by insistingon the legislation spirit of “disclosure is the principle, and non-disclosureis exceptional”.
