| As a product of the reform and innovation of administrative law enforcing system, city management Comprehensive Law Enforcement has become an important mode of the modern administrative law enforcement. In the current social transformation, the conflicts between various interests and stakeholders are gradually deepened. City management comprehensive law enforcement department has become an important sector to resolve this paradox in the process of city construction. However, due to a long-standing "official standard" idea, mode of city management Comprehensive Law Enforcement in our country fall behind, and it’s different from the construction of legal society. In the face of law enforcement conflict highlighted ceaselessly, the departments of city management Comprehensive Law Enforcement should explore how to restrict the power of law enforcement and how to balance the interests of all parties. The city management comprehensive law enforcement pattern is the key to solve this problem.This paper, begins with studying related literature at home and abroad, discusses the pattern of city management Comprehensive Law Enforcement, conclude a summary of previous scholars on issues related to the research, which includes4parts:the law enforcement concept, law enforcement pattern analysis, law enforcement problems, solutions.By reading relevant domestic and international city management synthesis law enforcement documents, I discovered that domestic research on city management comprehensive law enforcement is not very comprehensive. Basically they are published on newspapers and news reports. Relevant professional academic research is not many. In these research papers, I found that mode of successful city management Comprehensive Law Enforcement is less, it only exists in some major districts in the city, most regions’law enforcement mode are not effective. In these papers, discuss of city management Comprehensive Law Enforcement only focus on administrative management and administrative enforcement, analyses of the question only stay in the surface, they didn’t find the real conflict point. In view of the above, I decide to research on city management Comprehensive Law Enforcement.Before I start writing, I have learned related theory of city management synthesis law enforcement, after that, I delimit the city management synthesis law enforcement, define the city management, administrative law enforcement and mode, clear the difference between law enforcement mode and enforcement approach, and then lay the foundation of this paper.After defining the relevant concepts, I introduce the case of Shenyang hawker Xia Junfeng, begin legal analysis of city management comprehensive law enforcement pattern. In essence, a law enforcement model is essentially a balance between the benefits of city management law enforcement officer and law enforcement objects. The benefits include the rights to the use and restriction of power to power. In order to form a better law enforcement pattern, law enforcement officers must change the "official standard", keep "power stems from the people" in mind, to master the use of category of power, guarantee not to abuse power. The object of law enforcement should also make full use of their own rights to protect their own interests. Law enforcement officers must understand that, the macro social welfare includes not only the ordinary people’s welfare, but also including the welfare law enforcement objects. Law enforcement civilization is the whole society public’s demand; they should realize the power boundary location. On this basis, I introduce the "Own system" theory, prove the contradiction between the own system and the public power manufacturing system and the way it exist, and then lead to management law enforcement mode should be perfected by expound related contain of household registration system.Through research to our country’s city management Comprehensive Law Enforcement, I analysis and summarizes four China had or still exist law enforcement model which including the law enforcement model, professional management mode, construction mode, a joint law enforcement mode of the, through the comparison of the advantages and disadvantages of four law enforcement mode, forming the basic point of view their model, and thus expand the own analysis of city management comprehensive law enforcement pattern.In this paper, we first defined the necessity of the existence of the city management comprehensive law enforcement brigade. No doubt that city comprehensive law enforcement is controversial in our country, but the benefit it brings also can’t be ignored. There is still a need for the brigade, and it has its own authority, it’s necessary for us to improve the law enforcement model.In the analysis of China’s city management comprehensive law enforcement model, I firstly introduce the legal basis for the present stage of china’s city management comprehensive law enforcement mode, it can be found in the related literature review, the legislation is not perfect and the legal basis is not clear are the primary cause of comprehensive law enforcement pattern at present. This situation leads to law enforcement randomness appears frequently, the ways of enforcement are uneven, violence law enforcement even break rights of the citizens. Begin with the lack of legislation, I search Chengdu’s law enforcement basis of city management departments, find that it’s lack of harmony and balance, the law enforcement basis now is very fetched, as same as most area in our country. This situation leads me to analysis the reason of the contradiction.In the analysis of contradiction of city management Comprehensive Law Enforcement, I mainly analyze from theory and time these two aspects. In theory, I conclude that city management Comprehensive Law Enforcement goes against administrative law’s principle of Legal authority, authority untransferability, and law priority. In practice, by introduce the law enforcement officers’poor consciousness, poor service consciousness and poor comprehensive quality, I find the contradiction our law enforcement officers are facing.In view of these reasons, I analyze from two aspects of philosophy of law enforcement and law enforcement system, finding several reasons like:concept of law enforcement, conflicts of interest, law enforcement mechanism is not perfect. And thus I start to discuss city management comprehensive law enforcement pattern’s development direction.Because of the limited capacity, I can hardly offer come advice for city management Comprehensive Law Enforcement. But I can share my opinion about city management Comprehensive Law Enforcement’s development direction. This part I propose to strengthen legislation, improve the mechanism construction, strengthen supervision and establish a dispute settlement mechanism to improve Legislative and institution building. The most attractive part of this paper is that I emphasize the idea "people-oriented", and put this Enforcement philosophy as final basis. In my point, the key to improve law enforcement is to change people’s concept of law enforcement, only right concept can guarantee that perfect legislation could be carried out, and that’s why I emphasize the importance of law enforcement idea, why "people-oriented" idea penetrate the whole paper, and why I put "people-oriented" law enforcement idea as our country’s city management Comprehensive Law Enforcement development direction. |
