The Study Of The People’s Supervisor System Of Procuratorial Organs In Our Country

Abstract:In order to increase the sense of trust of the procuratorial organ judicial authority, in September2003, the Supreme People’s Procuratorate introduced the people’s supervisor system. The existing foundation of the people’s supervisor system is the Provisions of The Supreme People’s Procuratorate about the implementation of the People’s Supervisor System’s (the "Provisions") which has been implementing since October,2010.In Hunan Province, studying the practice status of procuratorial organ about people’s supervisor system can found that not only the prosecute crimes committed rate but also dismissal rates have declined, the law enforcement style and concept of procuratorial policemen has been standardized and transformation. In the practice process in Hunan Province about People’s Supervisor system, procuratorial organ’s pilot project in Zhuzhou successed in the reform of People’s Supervisor externalization’s election mode and remote supervision, which is treated as one of the scheme recommended to the all nation by Supreme People’s Procuratorate.Although the people’s supervisor system is an innovation of the procuratorial organ in the practice of the public participation in the judicial system. By examining the investigating system in Nippon, the grand jury system in the United States, the magistrate system in England,gain the beneficial enlightenment about how to improve the people’s supervisor system.The specific idea of improving the people’s supervisors system is to establish a pattern of the selection and designation system separated from the procuratorate,to reenact the tenure of people’s supervisors, to build training mechanism of people’s supervisor, to reform the way of fund guarantee of the people’s supervisor system, to supplement avoidance procedure provisions of the people’s supervisor, to reform supervision patterns, effectiveness and scope of people’s supervisors and make it move towards legalization.
