In the21st century, personal information is becoming an important social resource. The illegal collection and use of personal information, as a global legal issue, have attracted more and more attention. With the development of society and economy, conflicts of social interests about personal information are arising, especially the minors’personal information. Due to the immaturity of minors’ psychology and physiology, compared with the adults’information rights, the minors’ ones are more easily to be neglected and violated. Modern developed countries have established relatively well-developed legal system, in which detailed specific laws are enacted about the minors’ rights. By the method of comparative analysis, this thesis compares normative legal documents in order to explore the value and significance of minors’personal information protection system and discusses the way to improve this system in China against the problems arising from it.In addition to the introduction and conclusion, this thesis is divided into five parts:In the Part One, the current situation of the minors’personal information protection system is briefly discussed. Meanwhile, the defects of the legal system are analyzed.In the Part Two, the theory of the minors’ personal information protection system is elaborated, including the definition of personal information rights and content of the minors’personal information.In the Part Three, the specificity and necessity of the minors’ personal information protection system is explored. The relationship between the information rights and other rights, such as guardianship right, freedom of speech is discussed.In the Part Four, the minors’ personal information legislations in the United Kingdom, the United States, and Japan are compared and analyzed, providing reference for the minors’personal information protection legislation in China.In the Part Five, according to the foregoing analysis, applicable legislative model and the basic principles of legislation are proposed by comprehensive analysis.
