The Research Of Personal Information Using Conflict And Coordination With Human Rights Protection

There has been a subtle relationship between the use of personal information and behavior and the protection of personality for a long time,which has caused lots of legal problems.But we have not been paid enough attention to this legal system since then.However,the society is becoming into a information society,the value of the personal information is increasingly reflecting.In this process,people are enjoying the convenience which is brought by using the personal information,but also deeply feel the restrictions of our personality rights.Therefore,it is necessary to study the conflict and coordination between the using of personal information and the protection of personality rights.This paper focuses on the conflict between the use of personal information and the protection of personality,and tries to find the balance between the use of personal information and the protection of personality by analyzing the root of the conflict and study the experiences and norms from other developed countries.The first chapter is an overview of the use of personal information and the protection of personality,based on the definition of the concept of personal information on the basis of its nature,and personal information on the use of specific areas of the in-depth analysis of a clear personal information and personality There is a cross and contradictory relationship between protection.The second chapter analyzes the conflict between the use of personal information and the protection of personality rights.This part of the conflict through the use of personal information in two ways,that is,conflict of interest and conflict of rights.And through the analysis of the contents of the two kinds of conflicts in the use of personal information,and fully summed up the conflict between the use of personal information and the protection of personality rights.The third chapter has summarized the legislation of the personal information utilization in other countries and study from the points.Through in-depth summary of the major countries of the individual information on the use of relevant legislative norms and legal basis,and ultimately draw the relevant laws of developed countries on our reference.The fourth chapter is based on the analyses of the present situation of the using the personal information in our country,and absorbing the advantages which are summarized from the laws of other countries,the author puts forward some suggestions on the improvement of personal information from the theory and system.
