After the founding of New China, women began to participate in large-scale social production from the family to the community. Because of physical, psychological and social legacy of moral traditions, social legislation, law enforcement and other problems, and the constraints of other factors, various industries have emerged the phenomenon of infringing on women’s labor rights. Constitutional give women labor rights, and protection of women’s labor rights not only relates to the interests of women, but also to family harmony, and helps build a socialist harmonious society. Therefore, this paper attempts to explore the protection the work of women’s rights from "gender" perspective. First it has an overview of the theory of gender and public policy, and then analyzes the status of woman’s rights and their current problems. Then find out the reasons of violating rights and interests of women. Finally, suggest propose solutions to solve the problem of the protection of women’s labor rights.In addition to the introduction and conclusion, this article is divided into five parts.The first part introduces the basic concepts from gender to gender, gender awareness gender mainstreaming and gender perspective; introduces the basic concepts of public policy from the nature of public policy and the definitions of public policy; according to the needs of this article, this article briefly summarizes the horizontal classification of public policy. Then starting from the specific methods of gender analysis, this article points out that gender analysis is important for policy formulation.The second part analyzes concept of women’s labor rights by the labor theory of interests leads firstly; then it simply lists the legislative status of protection of women’s labor rights since the founding of China, then outline labor rights of women and their particular interests which our legal establishes and protects.The third part analyze the problem which exists in the protection of labor rights, including the inequality of employment opportunities for women in the current, serious gender discrimination, not standardizing about the enterprise employment system and poor working conditions, occupational threats, sexual harassment and other issues.The fourth part analyzes the reasons for violating labor rights and interests of women from which women themselves do not know the right, the weak self-protection awareness, the unequal status between employers and employees and the hysteresis of other relevant legislation and legal system reasons for.The fifth part puts forward suggestions to solve the problem of protecting labor rights and interests of women of Chinese enterprises from the problem and the reasons which the article mentions above.
