Research On Urban Illegal Construction Governance Issues Based On Polycentric Governance Theory

Over the past decade, this young and famous tropical seaside tourist city Sanya has accelerated the process of urbanization at an unprecedented rate, Sanya is entering into a period of large-scale development and construction, and the real estate industry has achieved the rapid development. Under the common effect of economic interest driven, housing demand and social network, illegally occupying the land for housing, illegally trading the land for housing, illegally digging and deforestation for housing, illegally building the illegal construction in the construction project planned land, making the illegal construction arbitrarily changing the planned land nature and other behaviors are on the rise, the illegal construction has become the "cancer" seriously influencing the order implementation of urban planning and disrupting the overall economic development of Sanya. Especially after officially naming Hainan International Tourism Island in2010, a large number of foreign speculators and local villagers are crazy building and not afraid of the government high-pressure strike trend, thus causing Sanya illegal buildings out of control.Through studying the related material on illegal construction, we can find the illegal construction has been researched from the legal perspective, urban management perspective, independently researching some region or some kind, and the economic perspective. However, few researches study the illegal construction governance from the perspective of polycentric governance. Therefore, with the research on the governance state of Sanya illegal construction, this paper tries to analyze the problems and reasons in the urban illegal construction governance process with the polycentric governance theory, discusses the governance mechanism of multiple subject governing the illegal construction, and proposes to construct the governance mode of government-led and multiple subjects-participation, and the methods to govern the urban illegal construction. The paper can be divided into five chapters. Chapter One is the introduction, which mainly introduces the research background, research significance, research content and research method of the paper, summarizes the domestic research trends related with the paper, and points out main innovation of the paper. Chapter Two is the related concept definition and theoretical foundation of urban illegal construction governance, which mainly discusses the basic concept of urban illegal construction and urban illegal construction governance, expounds main theory and analytical tool used in the research process, and points out the enlightenment of polycentric governance theory on the urban illegal construction governance. Chapter Three is the status and governance effect of Sanya illegal construction, which mainly introduces the status, feature, basic governance practice, governance process and achieved governance effect of Sanya illegal construction. Chapter Four is the existing problems and reason analysis for urban illegal construction governance, which analyzes existing problems and reasons for Sanya illegal construction governance from six aspects of governance concept, governance body, governance style, governance system, governance mechanism and governance institution. Chapter Five is the method to govern the urban illegal construction, which proposes the method to govern the urban illegal construction, such as changing the governance concept, proposing the diversity management; cultivating the multiple subjects, perfecting the governance structure; rationing the management system, perfecting the governance mechanism; broadening the multiple participation channels, perfecting the multiple participation system; perfecting the supporting policy and guaranteeing the housing supply.Illegal construction is the inevitable historical product in Sanya urbanization process with complicated reasons and multiple forms. Governing the illegal construction can not be done overnight, rather than it is a long-term and complex work. At present, Sanya exists many problems in governing the illegal construction. This paper mainly discusses that the multiple subjects shall participate in the governance of illegal construction, and proposes the multiple subject governance for the urban illegal construction, which means the government, community organization and residents shall commonly govern the illegal construction through the methods of cooperation, consultation and interaction, and finally achieve the goal of good urban governance, thus more standardizing and legalizing the urban construction and management, and making our Sanya more beautiful.
