Study On The Remedy For Rights Of University Students

In the building process of democracy and rule of law, governing school according to the law is a necessary requirement for constructing the modern university system with Chinese characteristics. As for now, the concept of law and law-based administration remain weak in universities. In higher education especially, disputes among students and universities are growing, the protection of vulnerable students’ right gets more and more valuable. The article aims to discuss the rights and rights relief provided for students in universities, by clearing orientation of universities, making definite the intention and extension of students’ rights and rights relief, through sorting out the legal relationships of the students and universities, define how university autonomy and academic freedom should effect rights relief provided for students. The article also tries to analyze the situation of rights relief of university students and investigate why does this come this way, then borrow insights from western collages in order to put forward the approaches to improve the rights relief in our universities, such as changing management ideas, improving the system of petition for students, innovations of dispute settlement mechanisms and judicial remedy. Lacking feasible legal measures for now, cultivating awareness of law would be a long-term and arduous task. Therefore, it requires joint efforts of the nation, universities, society and students, in the process of remedies.
