The University Student complaints system as a formal and specialized legal relief system within the institution of education, which has a clear comparative advantage in some respects, such as protecting the legitimate interest of university students,solving disputes between the university and the students, taking full advantage of the educational resources and so on, all these are the potential benefits that the people who expected in the system selection.The establishment and implementation of the College Student Complaints System has its effective germination on students' legal sensibility and the student's subjective initiative,effective promoting the entire development of college students on enhancing the comprehensive quality in themselves. Inn the study of the complaints system itself, we can find that it's the needs of respecting on the autonomy of universities and the needs to uphold the legitimate rights of students, promoting the construction of Democracy and legal system building of democracy at the same time, contributing to realize the cross balance between the public authority and the civil rights, helping to realize the final destination of the construction of harmonious Colleges and Universities. The contents of the new management regulation of college and university students, point out the flaws of complaint system, in 2005 includes many contents such as the subject, the main content,jurisdiction,time limitation and some others contents in complaints system. Compared with the old provision it does have the significant progress, but when we study it carefully, it's not hard to find that the new provision specificity in the complaints system has some major imperfects,for example,the range of the complaints are still limited to some extent, the procedure of the complaints are incomplete, the time limiting of the complainants are indefinite, the function of the complaints-processor organizations is not enough to play the key role in dealing with the complaints and some other aspects.Aimed at the complaints-system's improvement of the relevant issues,there are some analysis and exploration on it in the thesis.The thesis includes four parts; the basic content of the thesis can be summarized as follows:In the introduction content, the paper major summarized the source of the thesis and the research method, the state of study the thesis for the time being and the meaning of it in my paper.In the second part, the thesis put forward from the well performance on regulating the university self-management to put on the agenda of the students' protections. And the thesis summarized the relevant content from the types, characteristics and in its practice of establishing the necessities, and then raise the theory of resources in enforcing the laws and contents of the relevant theories to some extent.In the third part, through the study of the current procedure of operating in complaints system, making some analysis on its flaws.The thesis introduced the current situation in protecting the university students' rights in many countries, such as in The United States, Japan, Taiwan and our inland area. Where there is a right there is relief, the college students' legal rights should be protect by law, the college students' complaints system should be the main way on protecting their rights. The contents mainly analysis the flaws and deficiencies in the jurisdiction, the organizations which in processing the complaints, the procedure in the complaints system in China, I would raise some advices on developing the system in Part three.In the fourth part, comparing with the Part two, there are some advices on the analysis of the flaws and the deficiencies on the complaints system respectively. On the respect of the jurisdiction of the college students' complaints system, there are some advices aspects such as college students' rights to receive education, their personal rights, and their property rights. On the respect of the complaints-processor organizations,including the specific content of raising the quality of the staffing and the developing the function of the organization,in conjunction with the organization's working principles avail to establish the authority of the organization,realized the setting-up target of the organization's original function. On developing the procedure in the complaints system, it includes man specific procedures such as informing procedure, reason-giving procedure, hearing procedure, delivering procedure and some others procedures, all these advices on the procedure will do avail to the running of the proceedings more sufficiently. In addition, connecting the complaints system of university students with the Administrative litigation system, improving the relief functions of the college Students' complaints system further more.Only the complaints-processor organizations have been given full play to the college students' complaints system, enhancing the students' legal awareness, can we protect the college students' legal rights and benefits and solve the contradictions between the college and the students by the way of smoothie, more convenient, faster and easier, efficient, fairness, making energetic contribution to building a harmonious college and society of socialism!...
