Research On The Crew Of Our Country Social Security Right

China as the world’s largest maritime countries, the existing crew of165million people,ranking first in the world in which seafarers65million people, accounting for one third of theworld, such a large population, for the sustainable development of China’s shipping industry,economic growth, social made a great contribution to the stability, but because of theparticularity occupation, the right to social security has long been concern about the presenceof a small, inadequate protection, rescue mechanism imperfect, in a more vulnerableposition, and as China’s power to create shipping internal and external factors, the proposedimplementation of the marine Strategy, starting August20,2013," the InternationalMaritime Labour Convention2006" came into effect on a global scale, such as the impactand the overall progress of the society, to build a sound social security rights of our crewsystem becomes very urgent, therefore, to carry out research on the social security rights ofthe crew very important theoretical significance, social significance, practical significance.This article tries to theoretical perspective of law, that right as a starting point, thecrew right to social security system theoretical analysis to explain the meaning of the crewright to social security, extension, theoretical foundation, legitimacy, etc., and in contrast tothe social security rights of foreign crew based on the proposed practical measures andrecommendations with a view to improving the social security rights of seafarers researchsystem.The text is divided into five parts, the first part is the basic theory of social securitycrew, the crew right to social security connotation, denotation, content, legal propertyprotection and other aspects of significance are discussed; the second part of the use of legaltheory, exploring social security crew protection of the right of legitimacy, and from thehumane care and protection of human rights law to achieve justice and substantive justice,survival and development of three aspects to elaborate crew crew legitimacy of social securityprotection; third part of the existing social crew protect the rights of the content of empiricalresearch, identify shortcomings and to analyze the reasons for its existence; fourth part is inthe advanced experience of foreign crew Maritime Labour Convention and the right to socialsecurity in developed countries, to improve the social security protection mechanisms provided inspiration of the crew; the fifth crew from perfecting the system of social securityrights report, implementation mechanisms and improved relief mechanism, China’s socialsecurity rights of crew protection make recommendations accordingly.
