Applicative Research Of Community Service Order In Community Correction Of Juvenile Delinquency

Community service, also known as community service in foreign countries,social services, public welfare labor, labor compensation, etc., is a convicted personin the community in a certain time labor criminal sanctions. Community service forthe criminal punishment and correction provides a new way of education reform,reflected the restorative justice and the socialization of the concept of punishment andcriminal policy of tempering justice with mercy, especially suitable for the educationreform of juvenile criminal. Juvenile criminal mind, cognitive aspects are still notmature, should not treat by mature way of punishment, minor criminals usuallypersonal risk is small, also suitable for community service way of punishment.Starting from the positive prevention ideas of education, persuasion to save,community services should also be the preferred form of punishment of the criminallaw. Based on this background, in this paper, the community service in theapplicability of the minor crime is discussed. The main content of this paper are asfollows:The first part introduces the research background of this article, and put forwardthe research question. The second part expounds the related concepts of communityservice, firstly defines the connotation of community service, and then analyzes thecharacteristics and essence of community service, finally combed the developmentcourse of community service. The third part discusses the applicable value ofcommunity service in the minor crime, mainly includes four aspects: communityservice is beneficial to improve the quality of the minor crime transformation, isadvantageous to the criminal law of humanity, is advantageous to the correcteducation juvenile offenders, beneficial to the minor crime return to society.Community service in juvenile crime in the concrete implementation, mainlyintroduced the community service, the content of the community service to theimplementation of the process, to evaluate the effect of the implementation.
