With the rapid development of market economy, personal information has become a market economy resource. In particular, personal information of consumers, has become a major market operators in major competition for resources. Which operators to get more personal information about consumers, in a sense, it occupied more market share, make business decisions for further broaden the market, and make choices in line with market operation provided. Strengthen economic exchanges between people, the Internet, the popularity of networking technologies, access to personal information of consumers the way more and more damage to the behavior of consumers personal information inevitably occur, and there is a growing trend. This damage behavior, not only for individual consumers pose a threat to life and property, but also disrupt the normal operation of the market economy. China’s current legal protection of personal information of consumers is not perfect, the protection of personal information of consumers have not yet formed an effective, integrated system for consumers to collect personal information illegally, illegal use of behavior can not provide specific legal protection. In the specific judicial practice, violations of consumers’ personal information when violations occur, consumers can not get effective relief measures to protect their personal information, we can not form an effective fight against such violations. Based on the above analysis, the paper through the protection of personal information of consumers to start discussion, through the definition and protection of personal information to foreign consumers personal information about consumers to the concept of proprietary research and analysis, as well asChina’s current shortcomings in terms of consumer protection, propose solutions.The main contents are as follows: The first part, mainly for the protection of consumers ’personal information related concepts, to clarify the scope of consumer protection of personal information, and analyzes the reasons for consumers’ personal information protection, laying the groundwork for the next sub‐study.The second part of the study is to analyze the foreign consumer protection of personal information, comparative analysis of the United States, European Union, Japan legislation on the protection of consumers’ personal information and to make its assessment.The third part analyzes the conservation status of China’s current analysis of consumers ’personal information, through the analysis of legislative, judicial and individual consumers in three areas, to identify defects in our country in response to consumers’ personal information protection.The fourth part, based on the above analysis, legislative proposals to improve the protection of consumers’ personal information and response measures. Mainly from the legislative, judicial and specific relief, to improve our consumers’ personal information to provide reference.Research methods are mainly literature analysis, comparative analysis. Analysis by comparing the foreign legislative experience in the protection of personal information of consumers, attempts to provide legal advice for the protection of consumers’ personal information, which is the innovation of this paper.
