Research On The Application Of Creative Commons Under The Network Environment

Creative Commons is a new copyright license, it was first introduced by a non-profitorganization in USA, then spread in other countries. Traditional copyright system has someobstacles when used in the network environment, but Creative Commons used not only torapidly expand the influence of the works, but also has a positive impact for the disseminationof advanced social culture. Creative Commons is a special kind of copyright license whichdifferent from traditional copyright with "all rights reserved" requirements, it can still wellcoordinate with the traditional copyright system, breaking the rigid character of traditionalcopyright license so as to promote flourish development of network works.This thesis mainly uses the comparative research method, by comparing the CreativeCommons and traditional copyright system, making analysis of the development status offoreign and domestic Creative Commons from the concept to the legal relationship andapplication of Creative Commons in the global view, then offers some suggestions for dealingwith the possible infringement and default risks. At the same time, in this thesis, the methodof logical analysis in the setup section is adopted, according to the logical sequence ofquestions-analysis-solutions, asking why we should use Creative Commons, what theproblems when using Creative Commons, then making a theoretical analysis of its existenceand reality basis, so as to provide advices and suggestions for further promoting CreativeCommons.The innovation of this thesis lies in analyzing the possible infringement and default risksby including Creative Commons promotion organization and network service providers asthird parties, this method leads to a comprehensive analysis of various legal disputes in theapplication of Creative Commons, especially the possible infringement and default risks.Through the analysis of foreign cases, which may occur in our country, we could takemeasures to prevent the risks from taking place and provide advices and suggestions for betterapplying Creative Commons in our country. For perfecting the use of Creative Commons,giving full play to the existingcopyright protection system is needed, on the other hand, utilizing the successful licensemodels and characteristics of the models themselves to improve the further development forlocal application of Creative Commons.
