It brings a great change in the human world after the advent of the internet age. Facingthe explosion of Internet, copyright is strengthened through rapid expansion. However,over-protection from copyright will finally encroach on public interests. For the new pathof free creation, a project, called Creative Commons, is launched by Lawrence Lessig,which tries to make a balance between the two interests, copyright holders’ and public byCreative Commons licenses. In this paper, Creative Commons of intellectual property isanalyzed with variety research methods, in order to provide new models of copyrightprotection.This paper consists of five parts. In the first part, several related concepts areintroduced, which is the foundation for further discussion of Creative Commons. Then, theproject of Creative Commons is described, mainly about the development of CreativeCommons and its impact. The third part analyzes the background of Creative Commons,including reality background and theoretical background, i.e. the shift of works spreadingtendency due to the new technologies, the increase of editing works, legitimacy crisis ofintellectual property rights, post-modern deconstruction theory, the theory of meme, theconflict between the intellectual property rights and human rights. In the fourth part, thecontent of the Creative Commons license version2.5is introduced, and the existingproblems, especially the form and the conflicts with copyright are analyzed. Finally, on thebasis of the former parts, the paper draws a picture for Creative Commons and copyrightprotection, focusing on the future models of copyright protection in Creative Commons.
