The jury system is an important component of modern judicial system, as ordinarycitizens to participate in the national judicial activities of a procedure exists, at the same timeit is a country one of important signs of judicial democracy. The modern jury system can bedivided into the Anglo-American jury trial system and the continental law system, but itsessence is a democratic judicature. Since our country executes since the jury system, theimportant democratic legal system in our country to run and did not play its due valuefunction. In the current criminal procedure law, the jurors with not judge the phenomenon isvery common, how to play the role of the jury system, improving the judicial democracy, weneed to face reality. The expectations of our criminal jury system, analyze the existingproblems, and put forward the countermeasures and suggestions for improvement.The article is divided into four parts: the first part, discussed on the criminal jury systemand related concepts are defined, and their historical evolution and development of the secondpart, mainly; Anglo-American law and the continental law system the jury system wasinvestigated, and pointed out that both the jury system of our country construction inlegislation and the system development draw lessons from value; the third part, discusses thecriminal jury system in China ’s current situation, points out the existing problems, and thejury system the development of different viewpoints are introduced, and expounds theposition;the fourth part, focused on the criminal jury system in China of the perfect way andCountermeasure on jury system, construct and perfect specific measures were proposed,finally, perfecting the jury system in the protection of explained.
