Assisted reproductive technology as emerging bioscience, focus on the best interests of patient, moreover, it should take life ethics and legal construction seriously. In vitro fertilization and embryo transfer technique(IVF-ET) and its derivatives’ developing brings new fertility hope for infertile women, in reality, limited by the shortage of eggs,infertile women have to experience a long wait, combined with weak regulation and governance in the field, underground egg trading industry is flourishing, which impacts on people’s moral bottom line and disrupts the normal social order. China explicitly bans commercial behavior for eggs, that is because once human egg be tainted with "commercialization", it will produce a series of ethical and legal issues, which is not conducive to the new technology. Review the potential ethical and legal problems of egg trading, helps us to find out the corresponding countermeasures and to create a good social environment for the healthy development of assisted reproductive technology.The first part introduces the characteristics of egg trading in our country, then analyses the cause of it. The second part combings the potential problems of egg trading from two dimensions, the social ethics problems mainly include blaspheming the human life and dignity, exploiting the egg donors, which goes against social justice, inspiring human to choose offspring genes, increasing the risk of relatives mating; legal issues involve the legitimacy of agreement, personal injury claims and crime it may be caused in the process. The third part summarizes the ethical codes and legal norms abroad,mainly choose America and South Korea as a representative, analyzes the measures they took for egg trading problem and the enlightenment to our country. The fourth part puts forward countermeasures combined with China’s actual situation. In particular,to strengthen the health education of women for eggs, to help infertility family set up correct procreation conception, to perfect the egg bank construction and egg sharing plan in our country, to establish a national regulator and to perfect relevant legislation or come to a unified artificial reproductive law.
