Study On The Problems And Countermeasures Of House Demolition On Collective Land In Huzhou Development Zone

Since reform and opening up in China, the pace of urbanization is accelerating with the rapid economic development. A large number of rural houses on the collective land have been demolished during the process of urban expansion.Relative to the demolition of houses on state-owned land, house demolition on rural collective land from the national aspect has not set perfect system laws and regulations yet,so that the local government is fragmented. A series of social problems like the demolition program is not in place, the placement of the compensation is not reasonable and so on,which has seriously affected the social harmony and stability.Therefore,it is very urgent to strengthen the study of the house demolition on collective land. Similarly, Huzhou Development Zone,located in the forefront of urban development and construction^ facing multiple overlapping conflict problems in the current house demolition on collective land which urgent needed to formulate corresponding measures.Based on this,this paper takes the house demolition on collective land in Huzhou Development Zone as a case study. On the basis of the detail introducing about the current situation and useful experience of the house demolition on collective land, the author summarized the problems that still exist in the area of house demolition on collective land and analyzed the reasons for these problems.Also,from the work practice of the house demolition on the collective land in Huzhou Development Zone,the author puts forward the corresponding countermeasures.This paper argues that there are five aspects of outstanding problems in the house demolition on collective land in Huzhou Development Zone at present:The first was the resettlement policy can not be effectively unified; The second was the housing assessment standard was low and compensation mechanism was not scientific; The third was the placement of the housing construction in lagging behind,be taken to safeguard the interests of the lack of the mechanism; The fourth was the housing ownership was unclear, it failure to control illegal construction;The fifth was the demolition without examination and approval procedures,illegal demolition had occurred frequently.The main reasons that lead to these problems were the serious lack of laws and regulations,the local regulations was not perfect,the lack of management function, the lack of scientific demolition decisions, the government role positioning was not accurate,and demolition relief channel was not clear.Finally,the author put forward five countermeasures for the above problems:The first is to improve the laws and regulations,improve the construction of the system;The second is to formulate scientific compensation standard, improve the existing resettlement way;The third is to perfect the procedure of demolition, regulate the behavior of government order;The fourth is to expand public participation in the demolition, deepen the sunshine demolition to protect the fair;The fifth is to improve demolition relief way, forced relocation in accordance with the law.
