As the Real Estate industry is booming dramatically in the last decade, building area, a fundamental index in real estate’s measurement, has achieved the most attention from both investors and consumers of real estate. Facing the harsh competition in real estate market, developers introduce many promotion strategies, including the “free extra space”, to compete for consumer’s wallet to maximize their profit. Nevertheless, “Free Extra Space” comes from the difference in international criterion that are being applied in calculating building area by game players, including reverent government agencies and developers. The phenomenon could possibly leads to difficulties in government regulating the real estate industry, and protecting consumers from legal risk and potential safety concern. In the paper, from government, developer and consumer’s perspective, we analyze the impact of “ free extra space ” and try to find a way to gauge and control it. Furthermore, as professional area measuring analyst, I discuss area measurement as a guidance factor in the academic world of Architecture.First, we reflect on the modern history of Chinese real estate measurement industry, international trend in the industry, and summarize the ongoing process in preparing and marketing real estate projects. Also, we do the comparative studies on several laws, including the “Property measurement norms”,the”Construction area of building design specifications” and details in reverent law practices in the industry. Moreover, in our case study, the root reason why “free extra area” is popular among real estate developers and project designers and its respective impacts in cases will be present. Also, we discuss its impact on public policy making as well as generally on Architecture.Thorough the phenomenon “free extra space”, our aim is to understand the undesirable law discrepancies and its evolution in the context of Chinese real estate market. We try to provide reverent government agencies with the case studies and the advice on policy making and legal regulation, to reduce and even obliterate the friction caused by the “free extra space” and eventually promote public interest in living and housing.The paper consists of three part. The First part, including the chapter One and the chapter Two, is historical study and summary of the domestic real estate measurement as a booming industry, as well as international criterion and trends. The research models and outline is also introduced in the part, concluding with a theoretical analysis on the industry. The Second Part, mainly the chapter Three, is a empirical study into the Chinese real estate market’s conditions and structure. The Third Part of the chapter Four and Five is to analyse the phenomenon “free extra space” and find the root reason for it, which by nature is the fallacy in the legal system of law and regulation. Its impact on government, developer and consumers follows, while the meaningful influence on academic Architecture is also singled out. Finally, we provide our advises on policy making to counter-attack the undesirable phenomenon.
