Research On Environmental Dispute Settlement Mechanism In New Urbanization Construction

In the decades of the traditional urbanization in our country, we has been made on the rapid economic development, but the environment problem increasingly prominent followed. And the prominent environmental problems are caused by the production of environmental disputes. If mishandle the disputes, it will affect our living environment and social environment harmonious and unified to a certain extent.Since The 18 th National Congress of the Communist Party of China, new urbanization was known to the public. The intensive, intelligent, green, low carbon new path of urbanization became the new requirements of urbanization construction in our country, as Press Conference on New Urbanization Plan(2014-2020)announced. In such a context, in the face of environmental crisis and disputes arising from the construction of urbanization, how to improve the environmental dispute resolution mechanism is a difficult problem in front of us.The author thinks that, only the action mechanism and the non-lawsuit mechanism complement each other, is the long-term mechanism of the environmental dispute. But the lawsuit system in our country and the non-lawsuit system used to solve the environment dispute is insufficient, lack of procedure guarantee is one of the key.This paper concluded that in the construction of traditional urbanization, which the numbers of people only pay attention to industry and accumulations, and the development of economy, completely ignore the environment pollution problem by analyzing the concept and characteristics of traditional urbanization and new urbanization, summing up the differences between them. And that is exactly the problems what the new urbanization construction need to actively solve, also is the value of this article to study. Then, the paper summarize research results about environmental dispute settlement mechanism in Japan and the United States, focusing on new environmental laws, analyze the environment of our country’s existing disputesettlement mechanism, proposed the way of perfecting our country’s environmental dispute settlement mechanism under the background of the construction of the new urbanization.
