The Study On Public Participation In Environmental Protection

The human environment is being challenged by environmental crises caused by environmental problems, environmental protection is the safeguards to achieve sustainable human development, The public has gradually become the main driving force of environmental protection career development, become the community-led forces in the environmental movement, public participation in environmental protection has gradually become conscious、active participation in the maintenance of environmental quality from the initial spontaneous rights demands.In new China, Environmental protection has gone through nearly 40 years of history, the Chinese government defined the "mass line" at the beginning of the rise of environmental protection undertakings. After the United Nations Conference on environment and development in 1992, China has written "organizations and the public to participate in sustainable development " into Chinese" 21st Century agenda ". the public is an important force to promote the development of environmental protection. However, there are still some issues in public participation in environmental protection in China, the level in public environmental consciousness and environmental behavior of participation is low, the legal system of public participation is not perfect, the environmental protection NGOs did not play its due role, etc.This paper expounds the theory foundation of public participation in environmental protection, from the concept of the "public participation", focusing on environmental rights theory. By comparing the features of public participation in environmental protection between in the domestic and Chinese, focused on the analysis of the legal mechanism and the situation on public participation in environmental protection in several major Western countries,By the analysis of the cases, those domestic events such as PM2.5 into standard、PX dispute and others occurred in recent years, give some suggestions to improve our system of public participation in environmental protection, focusing on enhancing public consciousness of participation in environmental protection through environmental education、improving the relevant legal mechanism, establishing the status of public rights of environment, making the ways of public participation in environmental protection concrete, improving environmental information disclosure system、environmental public interest litigation system, enhancing environmental protection NGO’s influence in public participation.
