| Due to the massive use of the coal, oil and other fossil fuel which has caused enormous environmental and ecological problems, the nuclear power, as a clean energy, has been widely concerned. The radioactive isotope products which can be applied in the field of agriculture, medical and scientific research and environmental protection for the benefit of mankind has been vigorously developed. After a short period of 30 years, the civilian nuclear industry in China has reached a rapid development. The previous legal system in civilian nuclear industry has paid more attention on the front part of nuclear facilities construction, such as siting, building and operating. However, as the end part of civilian nuclear industry, the radioactive waste disposal, has not acquired much more attention than it should. At present, the dilemma of radioactive waste disposal in China mainly rests in the insufficiency of disposal capacity and inefficiency of disposal field construction, which can be finally attributed to the imperfection of our legal system in the radioactive waste disposal. As a result, in order to solve these problems mentioned above, it allows no delay to improve the legal system in radioactive waste disposal in China.The full text is divided into three parts, which are as follows:The first part, mainly expounds the basic theory of radioactive waste disposal. First of all, discusses the concept of radioactive waste. Secondly, introduces the sources, characteristics and damages of the radioactive waste. Thirdly, introduces the concept of civilian radioactive waste disposal. Finally, introduces the current situation of civilian radioactive waste disposal in our country: the location planning of disposal field has not yet been issued; the responsibility subject of disposal field construction has not been clearly confirmed and the disposal technology research and disposal field construction have been consistently lacking funds.The second part, mainly analyzes the legal system of radioactive waste disposal in our country. Firstly, sorts out the rules of radioactive waste disposal in China. Secondly, introduces the classification disposal system, the license system, the disposal field location planning system, the third-party disposal system in China. At last, analyzes the dilemma of legal system in radioactive waste disposal in our country which exists in the disposal field location planning system, the third-party disposal system, information disclosure and the public participation system and so on.The third part, mainly discusses the perfection of the legal system in radioactive waste disposal in China. First of all, the disposal field location planning system should be improved by reinterpreting the regional disposal policy, strictly enforcing three-stage simultaneous” system and establishing the economic compensation system. Secondly, the third-party disposal system should be improved by clearly defining the responsibility subject of disposal field construction and establishing the radioactive waste funds. Finally, we should also establish the information disclosure system and public participation system in radioactive waste disposal. |
