Water pollution incident happens, has become a problem which affected national economy sustainable development, affected the livelihood of the people, and even severely weakened public trust to the government. Its negative effect has been far beyond the visible, quantifiable economic losses, the negative effect of overflow increasingly cause the attention of people. In contrast, the water pollution management in our country, both legislative and administrative law enforcement, are also in the planned economy and the inertia of the "rule of man" thinking, outstanding performance is having not formed the concept of governance in accordance with the water pollution risk, not formed a set of legislation, law enforcement and judicial legal system and operational requirements which can adapt to the socialist market economic system in the aspect of water pollution risk management. This paper examines the theory of risk society about water pollution risk management research results both at home and abroad, the paper advocates the management of the risk of water pollution in our country should be shift from the planned economy and the rule of man’s thinking mode of management concept to market economy, democratic politics and governance patterns in the concept of the rule of law. Based on this understanding, under the concept of the rule of law, and from the Angle of legislation, law enforcement, the author analyzes the operation mechanism of the current water pollution riskmanagement in our country,and so as to improve the legal system of risk management of the water pollution in our country.
