A Research Of Agriculture Insurance Supervision Based On The Insured Farmers Protection Perspective

Agriculture is the basic industry of China’s national economy, but also a fragile industry. It requires the development of agricultural insurance to protect agricultural productions. Development of agricultural insurance is an important measure of government support and protection of agricultural. Agricultural insurance consumers in China is a vast number of farmers, they are the foundation of the survival and development of agricultural insurance. Although their overall educational level is not high, but simple, plain, good protection of the interests of the insured farmers is not only the bounden duty of the insurance regulators, but also an important criterion to measure effectiveness of supervision. In the current environment for the development and the rapid development of China’s agricultural insurance period, protecting the insured farmers’interests, not only helps to promote agricultural insurance standardize their operations, to promote the smooth development of China’s agricultural insurance undertakings, but also helps to protect the safety of national food production.This paper starts from the special purpose of the development of agricultural insurance, concentrating on agricultural insurance system in underwriting, claims, catastrophe loss-sharing. premium subsidies and other aspects of the damage to the interests of the insured farmers and the need for supervision, then combining with the actual analysis of the factors affecting the agriculture insurance regulators and insurance farmers’ rights and interests protection. On this basis, the paper draws on foreign agricultural insurance regulators and insurance farmers’ rights and interests protection of experience and puts forward suggestions to strengthen China’s agricultural insurance regulators and the insured farmers’ rights and interests protection.This paper consists of five parts. The main content and view of each part is as follows:Part one:To discuss the research background and significance of this paper and to summarize briefly those related literatures on domestic and overseas agricultural insurance supervision and the insured farmers’ rights and interests protection.Part two:Particularity of the development of China’s agricultural insurance and the necessity of supervision. Firstly, definition of China’s policy-oriented agricultural insurance development of special purpose and special requirements, proposes two special purposes:to promote the development of agriculture and to ensure food security; to reduce fluctuations in farmers ’income and to improve farmers’ welfare. Secondly, detailed focus analysis on the new problems facing large-scale development of China’s agricultural insurance and damages to insured farmers’ rights and interests. Finally, this paper comes to a brief overview of the objectives and practical significance of China’s agricultural insurance supervision. By the above analysis, the paper reaches a conclusion that China’s agricultural insurance supervision protects the insured farmers’ rights and interests and supervises safe use of the funds of the state financial subsidies, maintains fair and equitable agricultural insurance market.Part three:Analysis of the factors affecting agricultural insurance supervision and the insured farmers’ rights and interests protection. This section through the analysis of factors affecting China’s agricultural insurance regulators and insured farmers protection, draws several influence factors below:laws and regulations that regulate the development of the agricultural insurance system is not perfect, Organizational structure and service system of agricultural insurance operations can not keep up, as well as the existing agricultural insurance bull management and coordination mechanism is not established.Part four:The studies about the foreign agricultural insurance supervision and farmers’rights and interests. During this part, the author analysis common law and civil law systems of agricultural insurance supervision system, summaries up the value to China.Part five:Suggestions to strengthen the supervision of the agricultural insurance and to protect the insured farmers. By analysis, the author proposes five suggestions, including improving the agricultural insurance regulations and institutional construction, establishing the agricultural insurance service system, improving agricultural insurance supervision system, building mechanism of social supervision, playing a restraint mechanism of the self-regulatory organization of the insurance industry.The unique features and innovations of this paper include:1) The perspective of this paper is special.
