Study On Curing Reform Of The Rural Share Cooperation System In Pearl River Delta

Pearl River Delta as the forefront of reformation and opening in China, begancuring reform of the rural share cooperation system from1991. Take Panyu district forexample, there were244administrative villages in the implementation of curing reformat the end of2008, accounting for98.8%of the total number.Curing reform was a local form of the reform of rural share cooperation system,which obtained the right by remising the land tenancy in a certain period of time. Afterfixing the number of shareholders and shares, it disposed the shares to all theshareholders at one-time, with its "birth not increase, death not reduce " approach tolong-term fixed shares. But the shares could be inherited through statutes andprocedures. The interests of the share cooperation (such as land rents) would bedistributed according to the number of shareholders and shares, which no longer linkedwith the registered permanent residence, but would take shares as the new “accounts” ofthe distribution.This paper analysed the problems exposed in curing reform of the rural sharecooperation system through comparative studies, case studies, and summarize theresearch methods. The purpose was trying to perfect the curing reform by policyguidance and legal support to maximize the economic value in the process of rural sharecooperation system.The conclusions were as following:The curing reform of the rural share cooperation system combined the advantagesof joint-stock system and cooperation, and be in favor of gathering the workers, operators and owners together. The interests of operations would be distributed in acombination of distribution according to work and distribution according to dividends,which to further clarify the relationship between ownership and organization.There were a series of problems in the process of curing reform, which remainingto be further improved. Through in-depth study of Nanhai city, Lanhe town and Nancuntown, we found that the curing reform could be beneficial to maintaining social stabilityin rural areas, protecting the farmers’ interests, promoting the development of ruralcollective economic. But due to lack of legislation and administrative compulsorypractical factors such as, the existing reform measures are not perfect revealsshareholder identified the lack of clear legal provisions, equity closed and contradictsthe openness, equity and welfare contradicts the obligations of reciprocity, equity andpower functions of cooperative organizations "duality", the different nature of land,equivalent to cause damage to farmers ’ interests and other deep-rooted problems.In response to these shortcomings and deficiencies existed, in this article,stockholders’ equity, as well as supporting reform of legislation was raised by threeshares in solidifying reform measures in rural areas. First of all, shares in solidifyingreform legislation has become a necessity in rural areas. Market economy is the legaleconomy, shares in solidifying reform in rural areas economic and administrative meansalone, there must be holes. Thus, curing rural shares reform must be by formulatingrelevant laws, strengthened legal restraints on the economy and economic managementand role, both for cure economy in the long run provide a system guarantee of shares,shares in solidifying reform in rural areas will also play a guiding role. Secondly, whenshares in solidifying reform in rural areas, to the definition of property right on the basisof a reasonably curing economy equity shares, shareholder dividends and achieve abalance promoting economic development. Finally, perfect related supporting reformsin the rural share curing process reform is also very important. By speeding up the legislative process, the improvement of social security system in enterprises andmeasures such as the transformation of government functions, and vigorously promotethe rural share curing process, enable more people to share their results.
