Research The Problems And The Countermeasures Of The Circulation Of Contractual Operation Right Of Rural Land In Hebei Province

Rural household land contract system, emerged in the1980s, meets the need of theagricultural productivity, and therefore, greatly arouses farmers’ enthusiasm for production.And the food production keeps growing year by year, the1980s has witnessed thedevelopment of market economy, which is really pioneering at the time. In order tomaintain the family-based equal possession of land resources, modular approach andland-dividing contract are well used across China. But as time goes on, some structuralconflicts and problems have derived from the once fair and justified rural household landcontract system, namely, the separation between farmers and land, the conflict betweendecentralized management and agricultural modernization, and the conflict between urbanland management and the overall planning method as well as integrated land-using.Land management circulation means to promote the socialization of landmanagement, which is also the intrinsic requirement of rural land management systemperfection. What’s more, it can also be used an effective approach to resolve thefarmer-land conflicts. The development of China’s rural land circulation, on the other hand,is another way to interpret the contradictions between productive force and productionrelationship in rural China. And in this development process, rural land circulation mustfollow production-relation-meeting productivity law.From the perspective of land circulation modes and the land circulation ratio, theauthor analyzes the current situation of land management circulation in rural Hebei, andtherefore, discovers the problems and risk in Hebei’s rural land management circulation.The problems mentioned can be divided into two kinds: land falsely-declaring problemsand land-ownership has been changed; the risk include: farmers lose their land and landcannot be rehabilitated.With probe into the land circulation deeply，we find the reason which lead to thoseproblems and risks include: i. weak legal system in land circulation; ii. the conflict ofinterest in land circulation; iii. bad communication between upper and lower levels; iv.backwardness in cultivated land protection. Last but not least, the urban-rural dualisticsystem is also a problem which may be risk-taking.In order to escape from the risk in land circulation, suggestions are made as follows: i.special attention should be paid to law incompliance in land circulation; ii. farmers’ benefit should be protected and safeguarded; iii. a fair appeal and feedback system shouldbe build up; iv. land awareness construction should be strengthened.Land is the key to farmers’ livelihood issues. Land protection is another way ofprotecting farmers’ interest. Timely communication and appeal-taking can reduce conflictand risk to the minimum. To arouse farmers’ land awareness is to improve farmers’ qualityideologically, thus farmers’ would be willing to protect agricultural land. But theimplement and enforce must base on the support of law.
