The financial market is an important part of the modern economy. It plays adecisive role in promoting the development of economy. Since the1970s and, withfinancial integration and the wave of globalization, the world economy graduallybecomes an integration as a mutual influence overall. On the other hand, with thedevelopment of the world economy, capital market is gradually growing and makes anexpansion in a kind of special financial institutions which are out of control offinancial regulatory. These institutions, which run in the way of traditional banks,were called “shadow banking” by scholars. They were usually out of control of thegovernment. So they had made a great systemic risk. Many scholars regarded the riskof “shadow banking” as the main cause of leading the global financial crisis in2008.From then on, all the countries have paid great attention to these problems.The purpose of this thesis is to do a research on shadow banking and itsregulatory system. It analyzes the current situation of shadow banking of China, aswell as the financial supervision system. Then it makes appropriate recommendationsto improve financial regulation. Through systematic research on domestic and foreignliteratures, based on the method of the combination of historical analysis andcomparative analysis, with case analysis of the " Xiamen Melt Code Case”, the thesispresents some relevant conclusions.Our study suggests that the supervisions on the “Shadow banking” of China havethe following problems: lack of financial regulation, the inhibitions of financialinnovation by financial regulatory, the lack of risk supervision by financial regulatoryprocess, opaque financial regulatory, the imperfect disclosure mechanism, theweakness of financial internal control system and the industry self-regulation system.In order to solve the problems above, in this thesis, the following recommendationsare made: reasonable grasp of the relationship between financial regulation andfinancial innovation, strengthening the prudential supervision of the entire financialindustry, the establishment of coordination mechanism between the various regulatorybodies, and complete legal construction of the financial industry.
