The patent system plays a crucial role in the economic growth and societydevelopment of a country or a region, to an extent, the patent system determines the speedof the economic growth and society development. Researchers both of the domestic andoverseas have been all paying attentions on the problems about patent system, such as whatis the optimal, whether the patent system incents the activities about technological progress,and whether improves the industrial development, moreover, even the economical progress.Moreover, lots of countries have been improving and perfecting the patent system. Atpresent China puts forward the strategic target of constructing innovative country withseven strategic emerging industries, to speed up the upgrading of the industrial structure,promote the rapid development of our economy and society. The patent system, as the mostpowerful system foundation and guarantee of incenting technology innovations, shouldplay its own part. With modern biological technology in the medical field achievingbreakthrough, biopharmaceutical industry will grow up to be one of the sunrise industries,and it is bound up with people’s life. Now the industry in China will face the crisis called“patent cliff”, as one of the strategic industries, should seize the favorite opportunity, breakthrough the patent bottleneck, to drive the industrial development and upgrade, and alsobenefit the people in China. It is in the context that the paper does an empirical analysis onthe innovation performance and economic performance, points out the questions, and putsforward some suggestions.The first chapter summarizes the researches on the relationships between the patentsystem and technological innovation, describes the questions and measures about thepatent system and the operation process; the second chapter states the analysis models andtheoretical functions the scholars apply, and that is also the theoretical base for the analysisof the following chapters. The third makes an empirical analysis on the innovationperformance of the patent system in our biopharmaceutical industrial with the method ofquantitative and qualitative analysis on the indexes. The qualitative analysis mainly useFactor and Cluster analysis methods, to prove that patent system has a strong positiveeffect on the patent performance of the biopharmaceutical industry. The forth chapter isaimed to prove the relationship between the patent output and the progress of thebiopharmaceutical industry. There is a certain positive correlativity with the quantitativeanalysis and regression analysis. The fifth chapter, on the basis of the analysis above two chapters, points out the problems in the operation process of the patent system, and explainthe reasons. At last the paper puts forward the suggestions and proposals on theoptimization of the patent system and its operation mechanism.
