Research Of Countermeasures To Prevent Minor Crimes

According to statistics from2006to2010period, the number of cases of juvenile crime in China is growing rapidly, five years increased by nearly70%. Some scholars regard minor crimes, environmental pollution, and drug trafficking and abuse as Three Public Nuisances of society. So, it’s obviously that minor crimes have become serious social problems. The Paper proposed specific measures to complete the prevention of minor crimes through analyzing the present situations and reasons, as well as drawing lessons from successful experience of foreign countries.This Paper is divided into four parts:The first chapter briefly introducing the present situations of minor crimes, the characteristics of minor-crime’s nature, subject, form, age, and etc., and the minor criminal liability system of our country’s criminal law and minor criminal action system of our country’s criminal procedural law; the second part, mainly analyzing the problem why minor crimes exist through themselves, their families, their studies and the society; the third part mainly introducing the successful practice of foreign countries in preventing minor crimes, and analyzing combined with the actual situation; the last chapter summarizing and proposing suggestions to perfect the justice of minor crimes, prevention and community correction work in China:First is perfecting the minor criminal liability system. It can be realized mainly through the improvement of legislation, the establishment of the system of laws and regulations concerning with the minors, to provide legal guarantee for the implementation of the minor criminal liability system and the various measures; establishing and improving the systems, further clarifying the principle of leniency for minor delinquents; regulating the corresponding criminal discretion system to lenient treat the minor criminals; establishing special agencies to strengthen the protection of minor criminals’rights and interests.Second is perfecting the minor criminal litigation system. It can be achieved by establishing professional minor justice teams to strengthen the establishment of juvenile judiciaries; formulating The Juvenile Criminal Law minor to perfect minor the juvenile criminal judicial protection system; Strictly limited to the minors for the arrest of the principles and procedures, expand the attached conditions of minors is not to prosecute adapt, implementing appropriate adults participating system, strict divisional processing system and perfect minor’s legal aid system to strengthen the protection of the rights of minors in the proceedings, establishing minor criminal record system of elimination of minor criminal record.Last is strengthening the prevention of minor crimes and the correction in communities. It can be solved by means of complementing the social comprehensive governance of minor crimes; establishing community correction mechanism to perfect community construction, giving full play to the role of family education and improving the function of school education to reinforce the ideological and moral construction of the minors, and etc.
